1. AGREEMENT TO OFFICIAL RULES: Participation in the Winchester® Gear Store Giveaway Promotion (“Promotion”) constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Company, which are final and binding. Winning a Prize (as defined below) is contingent upon fulfilling all requirements set forth herein. Company: The Winchester Gear Store Giveaway is offered by Olin Winchester, LLC, 600 Powder Mill Road, East Alton, IL 62024 (“Company”).
2. ELIGIBILITY: This Promotion is open only to legal residents of the United States who, at the time of entry: (i) are at least 18 years of age (or the age of majority in their state of residence, if higher than 18), (ii) have or open a Facebook, Instagram or Twitter account during the Entry Period, and (iii) are not restricted in any way from owning a firearm or ammunition. Employees, officers and directors, their immediate family members (spouse, siblings, children and parents, regardless of where they live) or members of the same households (whether related or not) of Company, its affiliates, subsidiaries, advertising and promotion agencies and those entities associated with the development, distribution or implementation of this Promotion are not eligible to participate. Void where prohibited or restricted by law.
The selected Prize winner must conform to and demonstrate compliance with all local, state and federal regulations as applicable and, if necessary, must make arrangements for delivery of the ammunition with appropriate federally licensed firearms dealers as required by State and Federal law.
3. PROMOTION PERIOD: The Promotion runs from 12:00 am CST on April 27, 2022 until 5:00 pm CST on April 30, 2022 (the “Promotion Period”). Company's computer will be the official clock for the Promotion.
4. HOW TO ENTER: During the Promotion Period, eligible individuals may enter the Promotion by commenting on any of the Company's posts regarding the Promotion on the Winchester Instagram account, Facebook account or Twitter account.
To be a valid entry, the entry must:- Be submitted during the Promotion Period and comply with these Official Rules;
- Not be offensive, disparaging of, or infringing on any rights of others, in Company's sole discretion;
- Be in good taste and appropriate for the Facebook/Instagram/Twitter audience and Company's customers, in Company's sole discretion; and
- Comply with the Facebook, Instagram and Twitter Terms of Service (as applicable).
5. DAILY PRIZES. There will be ten (10) prize winners selected the day after the Promotion Period for a total of ten (10) total prize winners. Each winner selected will win one (1) Winchester American Legend Mug. The approximate retail value of each prize is: $7.00.
6. NUMBER OF ENTRIES. Each entrant may enter once per day during the Promotion Period. If an entrant submits multiple comments in one day, the comments will count as one entry for that day.
7. ODDS: Company estimates that the odds of winning each Prize will be 1/2,000. The actual odds of winning each Prize will depend upon the number of valid entries received. Many will enter, only eighteen individuals will win.
8. WINNER SELECTION: Each day during the Promotion Period, Company will randomly select ten (10) winners from all eligible entries received. Note that on weekends and any holidays during the Promotion Period, we will select a winner for each weekend and holiday, but the drawing will not take place until the following business day. The prize winners will be randomly selected at approximately 5:00 pm Central Time at the end of the Promotion period. The winners will be notified via direct message through the social media account used in entering the Promotion within five (5) business days of the winner selection. EACH ENTRANT IS SOLELY RESPONSIBLE FOR CHECKING THEIR SOCIAL MEDIA DIRECT MESSAGES AND EMAILS (IF APPLICABLE) FOR ANY NOTIFICATIONS REGARDING THIS PROMOTION, INCLUDING “MESSAGE REQUESTS.” If the selected winner does not respond within five (5) business days of the first notification attempt, is found to be ineligible, does not comply with these Official Rules or declines to accept the Prize, the selected winner may be disqualified in Company's sole discretion, and in such case, Company may select an alternate winner in a random drawing from remaining eligible entries. Company shall have no liability for a winner's failure to receive notices due to winner's spam, junk e-mail, social media account settings, or other security settings, or for winner's provision of incorrect or otherwise non-functioning contact information.
9. SOCIAL MEDIA: The Promotion will be advertised or administered through social media platforms, such as Facebook, Instagram, YouTube and Twitter (“Social Media”). You understand and acknowledge, however, that the Promotion is in no way sponsored, endorsed, administered by, or associated with any Social Media platform on which it is offered or advertised, including Facebook, Instagram and Twitter. You agree to adhere to all rules established by Social Media platforms and will not create multiple Social Media accounts, or repeatedly post duplicate or near duplicate information or links to enter into the Promotion multiple times. Any information you provide for the Promotion is being provided to Company rather than Facebook or any other Social Media platform. You fully release Facebook and all other Social Media from all claims, losses and harm that you may allege or incur relating to this Promotion.
10. NON-TRANSFERABLE. No transfer of any Prize to another person will be permitted. The winning Prizes may not be redeemed for cash.
11. RESPONSIBILITY FOR PRIZE. If you win one of the Prizes, you understand and agree that you are solely responsible for the use, transport, care and storage of the Prize, including (without limitation) paying any and all taxes and complying with any and all applicable laws.
12. PUBLICITY. Acceptance of any Prize constitutes consent for Company to use and share your social media posts regarding this Promotion, along with the use your name and likeness for editorial, advertising and publicity purposes without additional compensation, except where expressly prohibited by law. If you tag a post with other identifiable individuals, you represent and warrant that you have permission to use their name and likeness and to grant all rights herein.
13. OTHER REQUIREMENTS. The winner may, at Company's discretion, be required to sign and return a declaration of eligibility, additional release of liability, and, where lawful, an additional publicity consent agreement. If a selected winner cannot be contacted, is ineligible, fails to claim a Prize, or fails to return the completed and executed declaration and releases as required, the Prize will be forfeited and awarded to an alternate winner.
14. SUBSTITUTIONS & PRIZE VALUE. No cash or other substitution may be made for any Prize, except by the Company in its sole discretion. Company reserves the right to substitute a Prize with another prize of equal or greater value if the Prize is not available for any reason, as determined in Company's sole discretion. Any difference in the stated approximate retail value and the actual value of the Prize will not be awarded.
15. EXPENSES & TAXES. Prize winners are solely responsible for any applicable taxes, fees, insurance, and all other costs and requirements incurred in claiming, transporting, registering, or using the Prizes, and any other expenses associated with the prizes whether or not specified herein. Each Prize is considered taxable income, and winner will be solely responsible for all federal, state, and local taxes. When required by federal law, Company will report the names of the winner and the value of the Prizes won to the Internal Revenue Service. If requested by Company, the potential winner will be required to complete, sign and return to Company an IRS Form W-9 prior to receiving a Prize. Failure to complete, sign and return a W-9 will result in the winner being disqualified, and in such case, Company will select an alternate winner in a random drawing from remaining eligible entries.
16. LIMITATIONS. ALL PRIZES ARE AWARDED "AS IS" WITH NO GUARANTEE, REPRESENTATION OR WARRANTY, EXPRESS OR IMPLIED. COMPANY HEREBY DISCLAIMS ANY IMPLIED WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT AND FITNESS FOR A PARTICULAR PURPOSE.
17. RELEASE AND HOLD HARMLESS. BY ENTERING THE PROMOTION, YOU AGREE TO RELEASE AND HOLD COMPANY, ITS PARENT AND RELATED COMPANIES, AND THEIR RESPECTIVE EMPLOYEES, OFFICERS, DIRECTORS, SHAREHOLDERS, AGENTS, AND REPRESENTATIVES HARMLESS FROM AND AGAINST ANY AND ALL LOSSES, DAMAGES, RIGHTS, CLAIMS, AND ACTIONS OF ANY KIND ARISING IN CONNECTION WITH THE PROMOTION OR RESULTING FROM ACCEPTANCE, POSSESSION, USE, OR MISUSE OF A PRIZE, DEFECTS IN THE PRIZE, OR PARTICIPATION IN THE PROMOTION, INCLUDING (WITHOUT LIMITATION) CLAIMS BASED ON PERSONAL INJURY, DEATH, PROPERTY LOSS OR DAMAGE, PUBLICITY RIGHTS, DEFAMATION, AND/OR INVASION OF PRIVACY.
18. ERRORS. Company shall not be responsible for lost, late or misdirected entries, or entries containing incorrect or incomplete information. Company is not responsible for any problems or technical malfunctions of any mail network, telephone network or lines, computer, on-line, or Internet systems or services, servers, computer equipment, software, failure of any email or entry or confirmation or winners notice on account of technical problems or traffic congestion on the Internet, problems with Company's website or Social Media, or any combination thereof, including any injury or damage to entrant's or any other person's computer resulting from downloading any materials in connection with the Promotion. Entries become the property of Company and will not be acknowledged or returned.
19. RIGHT TO MODIFY OR TERMINATE THE PROMOTION. Company reserves the right, in its sole discretion and without notice, to terminate, modify or suspend the Promotion. If any computer or social media site associated with this Promotion does not allow the proper playing of the Promotion and the processing of entries per these rules, or if infection by computer virus, bugs, tampering, unauthorized intervention, actions by entrants, fraud, technical failures, supply chain issues, or any other causes, in Company's sole opinion, corrupt or affect the administration, security, fairness, integrity, or ability to conduct this Promotion, Company reserves the right, at its sole discretion, to disqualify any entrant implicated in such action, and/or to cancel, modify or suspend this Promotion or any portion thereof. In the event the Promotion is terminated, Company may select Prize winners through a random drawing from among all valid entries received before such impairment occurred, as determined by Company in its sole discretion. Company is not responsible for any typographical or other errors in the printing of these Official Rules, administration of this Promotion or in the announcement of any winner(s) or prize(s).
20. DISQUALIFICATION. Company, in its sole discretion, may disqualify an entrant, refuse to award the prize, and/or require return of any Prize if Entrant engages in any conduct Company deems to be improper, unfair, unlawful or otherwise adverse to the operation of the Promotion or detrimental to Company or the other entrants. Such improper conduct includes, but is not limited to, falsifying personal information required during registration or Prize claim, violating any term or condition stated herein, tampering with the administration of this Promotion, or intentionally trying to defraud Company. Any attempt by any person to undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and should such an attempt be made, the Company reserves the right to seek damages from any such person to the fullest extent permitted by law. Entrant further acknowledges that the forfeiture of a prize and/or return of a prize shall in no way prevent Company from pursuing other avenues of recourse such as criminal or civil proceedings if Entrant violates these rules or engages in any misconduct.
21. GENERAL CONDITIONS: All entries will be verified by Company personnel. By entering, all entrants agree to abide by and be bound by these rules and Company's decisions, which are final and binding in all matters. Noncompliance with these Official Rules will result in disqualification and forfeiture of any prizes won. Company's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
22. DISPUTES: Except where prohibited, entrant agrees that any and all disputes, claims, and causes of action arising out of, or connected with, the Promotion or any Prize awarded shall be resolved individually, WITHOUT RESORT TO ANY FORM OF CLASS ACTION, and exclusively by the appropriate court located in the State of Illinois. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant's rights and obligations, or the rights and obligations of the Company in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of State of Illinois, without giving effect to any choice of law or conflict of law rules (whether of the State of Illinois or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than State of Illinois.
23. PRIVACY POLICY. Company's use of any information you provide to Company as part of this Promotion shall be governed by Company's Privacy Policy. Company generally adds contact information it receives during promotions to its marketing mailing lists.
